Terms and Conditions

1. Enrollment:

Enrollment of The Hong Kong Children’s Musical Theatre Limited (hereinafter referred to as “HKCMT“, “CMT”, “we”, “our”) will be confirmed after selection and payment.

2. Fees:

  • Audition fee (HK$80) must be paid after completing the Audition Application Form to confirm successful application. The audition fee applies to the assigned audition day or classroom audition*. Audition fee is non-refundable.

    *If your child joins the classroom audition, you will need to pay a trial class fee, which will be charged according to his/her age group.
  • The admission fee (HK$520) is a one-time fee and must be paid upon enrollment. If you have withdrawn from the group (please refer to clause 5 of the terms for details) and re-enrol, you will need to pay the enrollment fee again.
  • Handbook Fee (HK$40) Each member needs to purchase a handbook to record the musical learning journey. If the handbook is lost/after completing 4 semesters, the member needs to purchase a new handbook.
  • Tuition fees are calculated based on the member’s age group and the number of classes in one semester.

    The first semester’s tuition fee must be paid upon enrollment, and the subsequent quarterly tuition fees must be paid on or before the 15th of the month before the start of the new semester.

    If the tuition fee is not paid on time, HKCMT may charge a late payment fee of HK$100 and reserve the right to suspend your child’s participation in the class, terminate the service, and give his/her degree to other members.

All fees paid including but not limited to registration fees, tuition fees and other fees and expenses are not refundable or transferable unless the course is cancelled or terminated due to the closure of HKCMT and the reasons stated in Clause 15 of these Terms and Conditions.

3. Sickness:

If your child feels sick or shows symptoms of any disease or communicable disease, please keep your child at home and inform HKCMT directly by phone (2566 6677) or Whatsapp (5517 8511) as soon as practicable. Your child should only return to class after recovering from any contagious diseases as evidenced by a medical certificate. If your child and/or his/her accompanying parent/ caregiver show any symptom of sickness or have body temperature over 37.5 °C or 99.5 °F, HKCMT shall have the right to request him/ her to leave the centre to safeguard the health and safety of all other children and parents/caregivers.

4. Make-up class arrangement:

a) Sickness/Personal reasons
If your child is unable to attend the class, please call us at 2566 6677 or Whatsapp 5517 8511 before the class. No make-up class will be arranged for absence due to sickness/personal reasons.

Unless the course is cancelled or terminated due to the closure of HKCMT and the reasons stated in Clause 15 of these Terms and Conditions, all fees paid will not be refunded or made-up.

(b) Class suspension arrangement
If HKCMT suspends any class due to any event or circumstance beyond the control of HKCMT and parents/force majeure (including but not limited to the outbreak of infectious diseases, any laws or actions taken by the government or public authorities, but excluding any inclement weather conditions), HKCMT shall not be in breach of this Agreement and shall not be liable for any delay or failure to perform any obligations under this Agreement. If the parents have prepaid the tuition fees for the cancelled class, the relevant tuition fees will be transferred to the class of the same period after the resumption of classes. If your child fails to attend the class of the same period after the resumption of classes for any reason (except for the closure of HKCMT and the cancellation or termination of the class of the same period due to the reasons stated in Article 15 of these Terms and Conditions), no refund or additional make-up class will be arranged.

5. Withdrawal Notification:

If you wish to apply for the withdrawal of a member, you must notify HKCMT via email/WhatsApp or in person at the Tin Hau Headquarters.

If a member takes a break for four consecutive seasons and HKCMT does not receive any reply/payment from any member’s parents during the period, it will be deemed as withdrawal.

Unless due to the closure of HKCMT and the cancellation or termination of the course due to the reasons stated in Article 15 of these Terms and Conditions, if your child withdraws from any course before the end of the course, any fees paid will not be refunded or transferred.

6. Attire:

To ensure the safety of members during musical training, all members must wear indoor shoes or non-slip socks during class. All personal belongings should be labelled with your child’s name. Members should avoid wearing necklaces, bracelets, jewellery or other similar accessories as they may increase the risk of injury. If you forget to bring indoor shoes or non-slip socks, you can purchase them from the company at a cost not included in the tuition fee.

Accompanying adults are required to remove their shoes and wear clean socks before entering our studios for classroom performances.

7. Health and Safety:

(a) HKCMT reserves the right to introduce new health and safety measures at any time and to change existing measures from time to time as necessary to protect the health and safety of members, parents, carers, tutors and staff.

(b) Medical Declaration and Disclosure: Parents must specify any known medical conditions, health problems, allergies or dietary restrictions of their children, or any requirements for HKCMT‘s health and safety measures when registering. The information provided will be kept confidential and only HKCMT staff will have access. If your child is unable to participate in any activities due to any known medical conditions, health problems, allergies or dietary restrictions during the company’s classes, or has been in contact with a person with an infectious disease, parents must notify the company as soon as possible via Whatsapp or email.

(c) Illness or Accidents in the Group: In the event of illness or accident at our premises requiring medical attention, HKCMT will try to contact the designated emergency contact person and/ or the parents of the child who is accompanied by his/her caregiver immediately.

(d) HKCMT shall not be liable for any and all losses, injuries, claims, damages and liabilities caused by or related to the group members if parents have not disclosed or informed the Group in writing of their child’s dietary restrictions, allergies or other medical conditions.

9. Personal Belongings:

Parents/Carers should remember to take good care of their personal belongings within the Group. HKCMT shall not be liable for any and all losses, injuries, claims, damages and liabilities caused by parents/carers.

10. Photographs, Videos and Recordings:

Except for HKCMT staff, in-class observation, photography, recording and videotaping are strictly prohibited within the Group.

Photos, videos or recordings taken by HKCMT will be used internally (e.g. as training staff or member records) and may also be used for external publicity and appear in course information leaflets, posters, newsletters, social media or website: www.hkcmt.org, etc. If parents disagree with this term, they must notify us by completing the “Parent/Guardian Consent Form” during registration. Please notify HKCMT staff any change of decision by Whatsapp text message or email.

11. Bad Weather Arrangements:

• Centre will be closed/operate until all students are picked up.

• If a Black Rainstorm Warning/Tropical Cyclone Warning Signal No.8 or above is still in force 2 hours before class time, the class will be canceled.

• If the observatory has issued relevant signals regarding the effective time (early warning), we will also refer to the early warning to decide whether to cancel classes.

• If a Black Rainstorm Warning takes effect during class, based on the guidelines to stay in a safe place, the course will continue at the class location. Parents are advised to pick up their children under safe conditions, and our team will arrange staff to look after the students until the last student leaves.

• The class will proceed as scheduled 2 hours after the issuance of Amber/Red Rainstorm Warning, Tropical Cyclone Signal No.1/No.3, or after all signals are canceled.

Classes canceled due to the aforementioned inclement weather will be rescheduled by the organization.

To ensure the safety of parents and students, HKCMT reserves the right to make special arrangements for classes based on weather conditions.

12. Security Closed Circuit Television (CCTV) System:

HKCMT is equipped with a CCTV system with cameras installed in prominent positions. To protect the safety of the center and individual children, these CCTV systems will record videos in accordance with the Hong Kong “Personal Data (Privacy) Ordinance” (hereinafter referred to as the “Privacy Ordinance”) and any applicable laws. Any collection, storage, disclosure, transfer and use of any personal data must comply with the troupe’s Privacy Policy.

HKCMT respects personal privacy. Unless we have obtained the express consent of each individual recorded in such video or any applicable exemption under the PDPO (e.g. HKCMT may disclose such information to law enforcement agencies for the prevention or investigation of crime under the exemption under Section 58(2) of the PDPO), such video will not be disclosed or transferred to any third party. Any data access request must be made to the person in charge of the Centre in accordance with the PDPO. Please note that the person in charge of the Centre may refuse to comply with a data access request in the circumstances set out in Section 20 of the PDPO.

13. Limitation of Liability:

To the maximum extent permitted by law, HKCMT and all our employees, directors, officers, agents, shareholders and affiliates shall not be held liable for any and all losses, injuries, claims, damages and liabilities arising from or related to the child’s attendance at HKCMT or use of the centre’s facilities, other than any liability for death or personal injury resulting from negligence by HKCMT or its employees, directors, officers, agents, shareholders or affiliates. Our liability to you for loss or damage of any kind (including loss or damage caused by negligence) is reduced to the extent that you caused or contributed to that loss or damage.

14. Refund Policy:

(a) HKCMT reserves the right to amend, cancel and terminate any courses and services provided at its sole discretion. No refund will be given for classes missed due to personal leave/sickness.

(b) If HKCMT cancels or ceases to operate any course, we will notify you at least 3 days before the cancellation or cessation of the course and provide you with any alternative arrangements (if any). If you reject all alternative arrangements, we will refund the tuition fees collected in full (for courses cancelled before the course starts) or on a pro rata basis (for any courses for which tuition fees have been paid but not yet taught before the cessation of operation).

(c) If HKCMT permanently closes any course before the course starts, we will refund the tuition fees collected for that course in full.

Regarding the refund procedure, we will inform the student’s parents or guardians in writing (email, fax or letter) of the refund arrangements and issue a refund receipt, which the student’s parents or guardians must sign to confirm the total refund amount.

15. Other matters:

(a) All teaching materials and course information of the Company are strictly for the use of members currently taking classes at HKCMT. All teaching materials of the Company are strictly prohibited from being reproduced in any form. If any form of reproduction of teaching materials is found, including but not limited to commercial use and teaching purposes outside the scope of the Company, we reserve the right to pursue legal liability.

(b) You agree to indemnify and hold HKCMT and its directors, employees, tutors, consultants, advisors and agents harmless from all claims, liabilities, costs, damages, losses and expenses arising from or related to your breach or violation of any applicable laws and regulations or these Terms and Conditions, including but not limited to any direct, indirect or consequential losses, loss of profits, loss of reputation and all interest, penalties and legal fees and all other professional fees and expenses. This indemnity does not apply if it is proved that any claim, liability, costs, damages, losses and expenses are direct and reasonably foreseeable and arise directly and solely from the negligence or willful default of the Company or its directors, officers, employees, consultants, advisors and agents. The Company reserves the right, at its own expense, to assume the exclusive defense and control of any matter not subject to indemnification by you, and in such event, you agree to cooperate with the Company’s defense of such claim.

(c) Each provision of these Terms and Conditions shall be deemed an agreement between you and the Company individually. If any provision is held to be invalid, illegal, unenforceable or unenforceable but would be effective if some of it were deleted, that provision shall apply with all necessary modifications to make it valid, legal and enforceable.

(d) HKCMT reserves the right to amend, modify, add or delete any of these Terms and Conditions and any of HKCMT’s courses and services at any time and from time to time at its sole discretion, but if we consider that the amendment, modification, addition or deletion of these Terms and Conditions and any of HKCMT’s courses and services is of a material nature, we will give you 30 days’ notice. Such amendment, modification, addition or deletion will take effect when it is posted on the Group’s website or when we give you notice. Your continued participation in the Group’s activities after any amendment to these Terms and Conditions will be deemed to have accepted such amendment.

(e) Save that any member of HKCMT may enforce these Terms and Conditions, a person who is not a part to this contract shall not have any right to enforce any terms of this contract or have any benefits under this contract. Subject to the immediately preceding sentence, application of the Contracts (Rights of Third Parties) Ordinance (Chapter 632 of the Laws of Hong Kong) is expressly excluded.

(f) This Agreement shall be governed by and construed in accordance with the laws of Hong Kong. Any dispute, controversy or claim arising out of or in connection with this Agreement, or the breach, termination or invalidity of this Agreement, shall be subject to the exclusive jurisdiction of the Hong Kong courts.
